Welcome to Trust ID, operated by Tracer Labs, Inc. ("Trust ID," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Trust ID platform, including our identity verification, consent management, and security services provided to government agencies, their contractors, and constituents.
By accessing or using the Trust ID platform, you agree to be bound by these Terms. If you are accessing the platform on behalf of a government agency or organization, you represent that you have the authority to bind that entity to these Terms. If you do not agree, do not access or use our services.
Trust ID provides identity verification, consent management, and security services designed for government agencies and their authorized users.

Government agency users are additionally bound by their agency's acceptable use policies and any terms specified in their service agreement with Trust ID. Violations may be reported to your agency's inspector general or designated oversight authority.
The Trust ID platform, including its software, design, text, graphics, logos, and all related intellectual property, is owned by Tracer Labs, Inc. and is protected by United States and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to access and use the platform in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of the platform or its content without our prior written consent.
Government agencies may retain rights to data generated through their use of the platform as specified in their service agreement. The Trust ID platform itself, including its proprietary algorithms, zero-knowledge proof protocols, and encryption methods, remains the exclusive property of Tracer Labs, Inc.
Your use of the Trust ID platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. Our privacy practices are designed to comply with applicable federal and state regulations, including COPPA, GDPR, and CCPA requirements.
The Trust ID platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or completely secure, although we employ industry-leading security measures including FIPS 140-2 Level 3 certified encryption.
To the maximum extent permitted by applicable law, Tracer Labs, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or related to your use of the platform.
Our total liability for any claims arising under these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim. This limitation applies regardless of the legal theory on which the claim is based.
You agree to indemnify, defend, and hold harmless Tracer Labs, Inc., its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the platform, your violation of these Terms, or your violation of any applicable law or regulation.
Government agencies' indemnification obligations may be limited by applicable sovereign immunity laws and the specific terms of their service agreement with Trust ID.
We may suspend or terminate your access to the Trust ID platform at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the platform ceases immediately.
For government agency accounts, termination procedures are governed by the terms of your service agreement, including any required notice periods and data transition provisions.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws provisions.
Any dispute arising under these Terms shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of Delaware.
For disputes with government agencies, resolution procedures may be subject to the Contract Disputes Act, applicable federal acquisition regulations, or the dispute resolution provisions specified in your agency's service agreement.
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our platform and updating the effective date. Your continued use of the platform after changes are posted constitutes your acceptance of the revised Terms.
For government agency partners, material changes to these Terms will be communicated through your designated contact channels with a minimum of 30 days' notice, unless otherwise specified in your service agreement.
